PopVaulty Terms of Use
Article 1 (Purpose)
These Terms of Use (the "Terms") are intended to define the rights, obligations, and responsibilities between PopVaulty (the "Service") and its users regarding the use of the Service.
Article 2 (Definitions)
The terms used in these Terms shall have the following meanings:
- "Service" refers to all online functions provided by PopVaulty that allow users to upload, share, and explore photos.
- "User" means any person, whether a registered member or a non-member, who accesses and uses the Service in accordance with these Terms.
- "Member" refers to a person who has registered an account with PopVaulty, and a "Non-member" refers to a person who uses certain features without registering an account.
- "Content" means all materials uploaded by users within the Service, including but not limited to photos, text, and tags.
- "Operator" means the entity responsible for providing and managing the Service, referred to in these Terms as the "PopVaulty Operations Team."
Article 3 (Effect and Amendment of the Terms)
- These Terms become effective upon posting on the initial screen of the Service or through a dedicated link.
- The Operator may amend these Terms to the extent that such amendments do not violate applicable laws.
- When making amendments, the Operator shall specify the effective date and reasons for the amendment and notify users at least seven (7) days prior to enforcement, or fourteen (14) days in advance in the case of significant changes.
- If a user does not agree to the revised Terms, the user may discontinue use of the Service and terminate their account.
Article 4 (Membership Registration and Account Management)
- Users may create an account by following the procedures prescribed by the Service.
- Users must provide accurate information during registration and promptly update any changes to their information. The user shall bear any disadvantages resulting from the provision of false or outdated information.
- Users are responsible for maintaining the confidentiality of their account credentials and must immediately notify the Operator in the event of password leakage or unauthorized use.
Article 5 (Provision and Modification of the Service)
- The Operator provides various features that allow users to upload, explore, save, and recommend photos.
- The specific content and delivery methods of the Service may be added, modified, or discontinued as necessary due to technical or operational reasons.
- The Service, when provided free of charge, may include advertisements, including personalized advertisements based on user interests and activity history.
Article 6 (Restriction and Suspension of Service Use)
The Operator may restrict or suspend all or part of the Service in the following cases:
- When performing system inspection, maintenance, replacement, or experiencing system failures
- When a user violates applicable laws, these Terms, or infringes upon the rights of others
- When a user disrupts the normal operation of the Service or causes technical risks
- When unavoidable circumstances such as natural disasters, power outages, or network failures occur
Except in urgent situations, the Operator shall notify users in advance. In unavoidable cases where prior notice is not possible, the Operator may provide post-notification.
Article 7 (User Obligations)
Users shall not engage in any of the following acts:
- Infringing upon the rights of others (including portrait rights and copyrights)
- Registering false information, using another person's identity, or accessing the Service through automated means (bots, scrapers, etc.)
- Posting obscene, violent, hateful, or discriminatory content
- Posting materials that violate laws or public order and morals
- Copying, distributing, selling, or otherwise commercially exploiting information obtained through the Service without authorization
- Interfering with the normal operation of the Service
If a user engages in any of the above acts, the Operator may take measures such as restricting service use, deleting posts, suspending, or terminating the user's account.
Article 8 (Rights and Use of Content)
- The copyright to content uploaded by a user belongs to that user.
- The user grants PopVaulty a non-exclusive license to use such content to the extent necessary for operation, display, storage, and distribution within the Service.
- The user shall ensure that their uploaded content does not infringe any third party's rights, including copyrights or portrait rights.
- The Operator may delete or restrict access to any content in response to legal requests or valid reports.
- In accordance with applicable laws such as the Copyright Act and the Information and Communications Network Act, the Operator may temporarily block or delete reported content and shall not be liable for any resulting damages.
- The Operator may terminate the accounts of users who repeatedly infringe upon the rights of others.
- The deletion or blocking of content may be notified electronically (e.g., via in-app notification or email).
Article 9 (Intellectual Property Rights)
- All intellectual property rights related to the Service, including but not limited to its logos, designs, user interface, software, and databases, belong to the Operator.
- Users may not reproduce, modify, distribute, sell, reverse engineer, or create derivative works based on the Service without the prior written consent of the Operator.
Article 10 (Limitation of Liability)
- The Operator shall not be liable for any damages caused by force majeure events such as natural disasters, wars, system failures, or network interruptions.
- Disputes between users shall be resolved between the parties themselves, and the Operator shall not intervene.
- The Operator does not guarantee the accuracy, reliability, or legality of content provided within the Service.
- The Operator is not obligated to pre-screen or monitor user-uploaded content and shall not be responsible for any disputes or damages arising therefrom.
- However, the Operator shall promptly take appropriate measures when reports or legal requests are received.
- The Service is provided on an "as is" basis without any express or implied warranties.
Article 11 (Advertisements and External Links)
- The Service may include advertisements or external links provided by third parties.
- The Operator is not responsible for the content, privacy practices, or transactions of external websites or services accessed through such links.
- Users are advised to review the terms of use and privacy policies of any external services they visit.
Article 12 (Termination of Use Agreement)
- Users may terminate their use of the Service at any time by deleting their account through the settings menu.
- The Operator may terminate the user's account after prior notice if the user violates these Terms or applicable laws.
- Upon account deletion, all user data and content related to the Service will be permanently deleted and cannot be restored, except where retention is required by law.
- In accordance with applicable laws such as the Electronic Commerce Act and the Personal Information Protection Act, certain information may be retained for a legally prescribed period and will be securely deleted thereafter.
Article 13 (Governing Law and Dispute Resolution)
- These Terms shall be governed by the laws of the Republic of Korea, provided that mandatory consumer protection laws of the user's country of residence shall prevail where applicable.
- Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court as the court of first instance, unless otherwise required by applicable laws.
- Data may be stored and processed on servers located in Singapore or other regions, and PopVaulty complies with relevant data protection regulations of such regions (including the Singapore PDPA).
Article 14 (Notices and Inquiries)
- The Operator may provide important information or announcements to users via email or in-app notifications.
